Business associates are organizations or individuals who perform services for a Covered Entity or for another Business Associate and, in doing so, create, receive, maintain, or transmit protected health information.

  • Business Associates include software vendors, cloud service providers, IT support companies, consultants, billing services, transcription vendors, customer support platforms, analytics providers, and many others

  • If your organization handles PHI, you have direct regulatory obligations to protect it

  • Since 2013, Business Associates have been directly subject to large portions of the Privacy Rule, the full Security Rule, and the Breach Notification Rule of HIPAA
